Nine suspended members of the Machakos County Assembly, among them Majority Leader Nicholas Kitavi Nzioka, received a temporary reprieve from the courts today—though under a firm warning to conduct themselves with decorum.
Lady Justice Noel Adagi, sitting in Machakos, lifted the initial suspension of eight sitting days imposed on the MCAs but made it clear that the grace would only last if they kept order.


She ruled that all the applicants must maintain law and order once the order is complied with, failing which the court would discharge the reprieve or issue further appropriate orders.
Those affected include Majority Leader Nicholas Nzioka, Deputy Speaker Stephen Nzue Mwanthi, ousted Minority Leader Judas Mbili Ndawa, and MCAs Felix Mutunga Ngui, Raphael Lucky Nzau, Charles Mbuva, Phoebe Koki, Anna Nthenya Ndilo and Catherine Kyee
The nine were suspended after a chaotic Tuesday session in which Speaker Anne Kiusya named them for being violent and disorderly. Trouble broke out when Nzioka fiercely interrupted the Speaker as she read her communication. A fistfight ensued, and the Speaker was forced to flee the chamber, with Mr Ngui chasing her through the back door.
The following day, the Assembly Speaker handed down a further suspension of 28 sitting days for the same group, effectively locking them out for a total of 36 sittings—an order that stretches into February 2026.
But the court’s decision today, delivered with a clear warning, has placed the MCAs on notice.
The matter will return to court for an inter partes hearing on July 8, 2025. The Assembly was served with the order at 4.20 p.m. today.
Separately, Mr Ndawa secured an order from the Political Parties Dispute Resolution Tribunal barring his party from removing him as Minority Leader. The Tribunal, chaired by Desma Nungo, scheduled the hearing for June 20, 2025.
